1. Controller

Jungkraut AG, Baarerstrasse 2, 6300 Zug, Switzerland, operates the websites jungkraut.ch and jungkraut.com together with their subdomains (hereinafter "website") and is responsible for the data processing described here. We comply with the revised Swiss Data Protection Act (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

This policy is reviewed and updated regularly. The current version published on the website applies.

3. Your rights

Where the legal requirements are met, you have the right to access, rectification, erasure, restriction of processing and data portability, as well as the right to withdraw any consent given at any time and to object at any time to processing for direct marketing purposes. You can also lodge a complaint with the competent supervisory authority (in Switzerland: the Federal Data Protection and Information Commissioner FDPIC; in the EU: the supervisory authority of your country of residence).

4. Data security

We protect your data with appropriate technical and organisational measures, which we continuously adapt to the state of the art. Transmission over the internet nevertheless carries residual risks.

5. Processing in connection with the shop and customer relationship

5.1 Contacting us: If you contact us by email, phone or contact form, we process your details in order to respond to your enquiry.

5.2 Customer account: When you register, we collect your name, email and password. The account can be deleted at any time.

5.3 Orders and contract processing: To process your order, we handle order, address and payment data. Without this data, a contract cannot be concluded.

5.4 Shop system and hosting: Our shop runs on Shopify (Shopify International Ltd., Ireland / Shopify Inc., Canada). As a processor, Shopify processes order, account and log data, among other things. 5.5 Payment service providers: Payment processing is handled via Shopify Payments (Shopify International Ltd. or its payment partners). The data required for the payment (e. g. name, amount, payment method) is processed by Shopify Payments and the respective card network or the payment service selected during the order process. The privacy notices of the respective provider additionally apply.

5.6 Shipping service providers: For delivery, we pass on your name, delivery address and, where necessary for delivery, your email/phone number to DHL, GLS or Swiss Post.

6. Marketing

6.1 Newsletter and email marketing (Klaviyo): For newsletters and transaction-related emails, we use Klaviyo (Klaviyo Inc., USA). We process your email address, name and interaction data (e. g. opens, clicks, purchases) for personalisation. Sign-up is based on your consent, which you can withdraw at any time via the unsubscribe link. A data processing agreement is in place with Klaviyo; transfers to the USA take place on the basis of recognised safeguards.

6.2 CRM: We link customer and interaction data in order to handle enquiries efficiently and display relevant offers (legitimate interest).

7. Retention

We store personal data only for as long as is necessary for the stated purposes or as required by statutory retention obligations (e. g. 10 years under accounting law).

B. Website, cookies and analytics

8. Cookies and consent management

We use cookies and similar technologies. Non-essential cookies (statistics, marketing) are only used with your consent via the cookie banner; you can adjust your selection there at any time. You can also block or delete cookies in your browser.

9. Google Analytics 4

10. Google Ads

We use Google Ads including conversion measurement and remarketing to serve advertising and measure its success. Cookies may be set and pseudonymous usage profiles created. The legal basis is your consent.

11. Meta Pixel

We use the Meta Pixel (Meta Platforms Ireland Ltd.) to manage advertisements on Facebook and Instagram and to measure their success. Usage data is transmitted to Meta and may be linked to your Meta account. The legal basis is your consent. Information: Meta Privacy Policy.

12. Product reviews (Judge.me)

For product reviews, we use Judge.me (Judge.me Ltd.). When you submit a review, your name (or initials), email address, review content and order reference are processed in order to verify and display the review. The legal basis is your consent.

13. Social media

Our website links to our profiles on social networks. You are only redirected once you click; the privacy policy of the respective network then applies.

14. AI-assisted content and communication

We use artificial intelligence (AI) to create and improve content on our website. Texts, images and other content may be partially AI-enhanced or fully AI-generated; we take editorial responsibility for them and review them.

Responses in customer communication – for example in chat or by email – may also be created with AI support or entirely AI-based in order to help you faster and more precisely. Where personal data is processed in the course of this, this occurs only to the extent necessary to respond to your enquiry and within the scope of this privacy policy; the AI service providers we use are contractually bound to confidentiality. Your data is not released for training public AI models. If you would prefer your enquiry to be handled without AI support, simply let us know.
